Garza Labor, LLC (“Garza Labor,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit garzalabor.com (the “Site”), apply for work with us, request our labor contracting services, or otherwise interact with us online.

Garza Labor is a labor contractor headquartered in Grand Rapids, Michigan. We recruit and employ domestic, H-2A, and H-2B workers and provide labor services to businesses in agriculture, hospitality, production, and other industries.

This policy applies to information collected through the Site and related online forms, email, text messages, and phone calls. It does not cover information we handle as part of an active employment relationship, which is described in separate employee notices provided at hiring.

By using the Site, you agree to the practices described here. If you do not agree, please do not use the Site.

2. Information We Collect

We collect information you give us, information gathered automatically when you use the Site, and information from third parties.

When you contact us

We only request sensitive information, such as passport or government ID details, when it is needed for hiring, immigration, or legal compliance. Please do not send sensitive information through general contact forms.

Information collected automatically

When you visit the Site, we and our service providers may collect your IP address, browser type, device type, operating system, referring pages, pages viewed, time spent on pages, and approximate location based on IP address. We collect this through cookies and similar technologies, described in Section 5.

Information from third parties

We may receive information from job boards, recruiting partners, references you provide, background check providers (with your authorization), government agencies involved in visa processing, and business partners who refer customers to us.

3. How We Use Your Information

We use personal information to run our recruiting and labor contracting business and to meet our legal obligations. Specifically, we use it to:

  • Review job applications, match applicants with open positions, and communicate about job opportunities
  • Determine eligibility for work and prepare H-2A, H-2B, and other employment-related filings with government agencies
  • Arrange travel, housing, and onboarding for workers when part of a job offer
  • Respond to inquiries from businesses and provide quotes, contracts, and labor services
  • Send service messages, job alerts, and updates by email, phone, or text message (see “Text messages” below)
  • Operate, secure, and improve the Site, and understand how visitors use it
  • Detect and prevent fraud, recruitment scams, and unauthorized activity
  • Comply with federal, state, and local laws, including labor, wage, immigration, and recordkeeping requirements
  • Establish, exercise, or defend legal claims

We never charge workers recruitment fees. Anyone asking you to pay for a job with Garza Labor is not acting on our behalf. Please report it to us using the contact details in Section 10.

Text messages

If you provide your mobile number and agree to receive texts, we may send messages about applications, job opportunities, and scheduling. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to receive texts is not a condition of employment or of purchasing services. We do not sell or share mobile numbers or text messaging consent with third parties for their marketing.

4. How We Share Your Information

We do not sell your personal information. We share it only as described below.

  • Client businesses. We share relevant applicant and worker details (such as name, skills, availability, and assignment information) with the businesses where workers are placed.
  • Government agencies. We share information with agencies such as the U.S. Department of Labor, U.S. Citizenship and Immigration Services, the U.S. Department of State, and state workforce agencies as required to process visas and meet legal obligations.
  • Service providers. We use vendors for website hosting, applicant tracking, payroll, background checks, travel and housing arrangements, communications, and analytics. They may use your information only to perform services for us.
  • Legal and safety reasons. We may disclose information to comply with law, a subpoena, or court order, or to protect the rights, property, or safety of Garza Labor, our workers, customers, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.
  • With your consent. We may share information for other purposes when you ask us to or agree to it.

You can block or delete cookies through your browser settings, though some features may stop working. To opt out of Google Analytics, you can install the Google Analytics Opt-out Browser Add-on. Where required by law, we honor Global Privacy Control (GPC) signals as a request to opt out of targeted advertising or sharing. The Site does not currently respond to “Do Not Track” signals, because no common standard for them exists.

6. Data Retention

We keep personal information only as long as needed for the purposes in this policy, or longer when the law requires it. Labor and immigration laws require us to keep certain records, such as H-2A and H-2B job orders, payroll, and work authorization documents, for set periods after employment ends. Applicant information that does not lead to a hire is generally kept for [two (2)] years so we can consider you for future openings, unless you ask us to delete it sooner. When information is no longer needed, we delete it or make it anonymous.

7. Data Security

We use administrative, technical, and physical safeguards to protect personal information. These include encryption in transit, access limited to staff who need it, and vendor security reviews. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you as required by law.

8. Your Privacy Rights and Choices

You can make the following choices at any time:

  • Email: Click “unsubscribe” in any marketing email.
  • Text messages: Reply STOP to any text.
  • Cookies: Adjust your browser settings, as explained in Section 5.
  • Update your information: Contact us to correct your application or contact details.
How to make a request

Email contact@garzalabor.com or call (616) 272-4969. We will verify your identity before acting, and we will respond within the time required by law, usually 45 days. You may use an authorized agent, who must show written permission from you. If we deny your request, you may appeal by replying to our decision, and we will respond to the appeal as required by law.

9. Other Important Information

Children’s privacy. The Site is not directed to children under 13, and we do not knowingly collect their personal information. Applicants must meet the minimum age required by law for the position. If you believe a child has given us personal information, contact us and we will delete it.

Third-party links. The Site may link to other websites, such as job boards or government sites. We are not responsible for their privacy practices, so please review their policies.

International visitors and workers. We are based in the United States. If you apply from another country, including for an H-2A or H-2B position, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

Language. This policy may be provided in Spanish and other languages. If versions differ, the English version controls.

Changes to this policy. We may update this policy from time to time. We will post the updated version on this page and change the effective date at the top. If we make material changes, we will give additional notice, such as a notice on the Site.
