It is mandatory to compensate all employees working in the H-2A designation, regardless of their nationality, with the greatest amount possible from the following options: (1) Your state’s Adverse Effect Wage Rate (AEWR); (2) the current hourly or piecemeal rate in the state; (3) a collectively decided wage within a bargaining union; or (4) the minimum wage set by the federal or state government. The AEWR is typically regarded as the relevant hourly rate in the majority of situations.
