The H-2B program allows employers to temporarily hire nonimmigrants to perform nonagricultural labor or services. The H-2A program is specific for temporary agricultural workers to help US farmers and agribusiness employers hire nonimmigrant foreign workers for seasonal work. So the key difference is in the sector or industry of work, as both visas allow foreign workers to work temporarily in the United States.
It is mandatory to compensate all employees working in the H-2A designation, regardless of their nationality, with the greatest amount possible from the following options: (1) Your state’s Adverse Effect Wage Rate (AEWR); (2) the current hourly or piecemeal rate in the state; (3) a collectively decided wage within a bargaining union; or (4) the minimum wage set by the federal or state government. The AEWR is typically regarded as the relevant hourly rate in the majority of situations.
